Grace In Action App

1. Description of Service

Grace In Action is a Christian devotional and song App that provides users with daily devotionals, original songs created by Grace Ridge Music, and related content. We also offer Church curriculum programs for Pastors, including devotionals, guide books for church members, and leadership materials for Pastors. The App includes features such as payment processing for subscription plans, a Family Dashboard, and song downloads.

2. User Accounts

2.1. Account Creation: To access certain features of the App, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

2.2. Account Security: You are responsible for maintaining the confidentiality of your account credentials, including your username and password. You are responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized access to or use of your account.

2.3. Family Dashboard: The App includes a Family Dashboard feature that allows parents to create secure accounts for their children to explore the App. Parents are responsible for monitoring their children's use of the App and ensuring that it complies with these Terms.

3. Subscription and Payment

3.1. Subscription Plans: Access to certain features and content of the App may require a paid subscription. We offer various subscription plans with different features and pricing.

3.2. Payment Processing: Payments for subscription plans are processed through Stripe, a third-party payment processor. By subscribing to a paid plan, you agree to Stripe's terms of service and privacy policy. We do not directly collect or store your payment information.

3.3. Subscription Renewals: Subscriptions automatically renew at the end of each billing cycle unless you cancel your subscription before the renewal date. You can manage your subscription through your account settings in the App.

3.4. Free Downloads: Subscribers receive at least three (3) free song downloads every thirty (30) days.

3.5. Changes to Subscription Plans and Pricing: We reserve the right to modify subscription plans and pricing at any time. We will provide you with reasonable notice of any changes to subscription plans or pricing.

4. User Content

4.1. User-Generated Content: The App may allow users to post, upload, or otherwise submit content, including comments, messages, and other materials ("User Content"). You are solely responsible for your User Content and the consequences of posting or publishing it.

4.2. Ownership of User Content: You retain all rights to your User Content. However, by posting, uploading, or submitting User Content to the App, you grant Grace Ridge Foundation a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with the App and our business.

4.3. User Content Restrictions: You agree not to post, upload, or submit any User Content that is:

• Unlawful, libelous, defamatory, obscene, pornographic, indecent, lewd, suggestive, harassing, threatening, invasive of privacy or publicity rights, abusive, inflammatory, fraudulent, or otherwise objectionable;
• Violates any third party's intellectual property rights, including copyrights, trademarks, or patents;
• Contains viruses, malware, or other harmful code;
• Solicits personal information from children under the age of 13;
• Violates any applicable law or regulation.

4.4. Monitoring User Content: We have the right, but not the obligation, to monitor User Content and to remove or disable access to any User Content that we believe violates these Terms.

5. Intellectual Property

5.1. Grace Ridge Foundation Content: The App and its content, including but not limited to devotionals, songs, text, graphics, images, software, and other materials (collectively, "Grace Ridge Foundation Content"), are owned by or licensed to Grace Ridge Foundation and are protected by copyright, trademark, and other intellectual property laws.

5.2. Limited License: Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the App and the Grace Ridge Foundation Content for your personal, non-commercial use.

5.3. Restrictions: You may not:

• Copy, modify, distribute, sell, lease, or create derivative works of the App or the Grace Ridge Foundation Content;
• Reverse engineer, decompile, or disassemble the App;
• Remove any copyright, trademark, or other proprietary notices from the App or the Grace Ridge Foundation Content;
• Use the App or the Grace Ridge Foundation Content for any commercial purpose without our express written consent.

6. Data Collection and Privacy

6.1. Data Collection: We collect certain information from you when you use the App, including your name, email address, and phone number (if you choose to provide it). Stripe collects your payment information when you subscribe to a paid plan.

6.2. Privacy Policy: Our Privacy Policy describes how we collect, use, and share your information. By using the App, you agree to our Privacy Policy, which is incorporated into these Terms.

7. Third-Party Links and Services

The App may contain links to third-party websites or services that are not owned or controlled by Grace Ridge Foundation. We are not responsible for the content or privacy practices of these third-party websites or services. Your use of third-party websites or services is at your own risk.

8. Termination

We may terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App will immediately cease.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, GRACE RIDGE MUSIC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE APP, INCLUDING WITHOUT LIMITATION, ANY DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF OTHER USERS OR THIRD PARTIES; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

11. Indemnification

You agree to indemnify and hold Grace Ridge Foundation harmless from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the App, your User Content, or your violation of these Terms.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Deland, FL.

13. Changes to These Terms

We may modify these Terms at any time by posting the revised Terms on the App. Your continued use of the App after the posting of revised Terms constitutes your acceptance of the revised Terms.
